GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter the "GTC") are entered into between, on the one hand, EI Lysa He, a sole proprietorship with its registered office at 38 rue de Berri, 75008 Paris, registered with the Paris Trade and Companies Register under number 105 378 947 (hereinafter the "Company"), operating the website www.ycooparis.com (hereinafter the "Website"), and, on the other hand, any natural or legal person wishing to make a purchase via the Website (hereinafter the "Customer").

Article 1 – Purpose
These GTC define the contractual relationship between the Company and the Customer and the conditions applicable to any purchase made through the Website, concerning products offered for sale exclusively on the Website.

Any use of the Website implies the Customer’s full and unconditional acceptance of these GTC, which the Customer acknowledges having read prior to placing an order.

The Website enables the Company to offer its products (hereinafter the "Products") in France and within European Union countries.

Prior to any transaction, the Customer declares that the purchase of Products on the Website is not directly related to their professional activity and is strictly for personal use, and that they have full legal capacity to commit under these GTC.

The Company reserves the right to amend these GTC at any time to comply with new regulations or to improve the use of its Website. The applicable terms are those in force at the time of their publication online.

Article 2 – Products
The Products offered are those listed on the Website, subject to availability. If one or more items ordered are unavailable, the Customer will be informed by email as soon as possible of the partial or total cancellation of the order.

The Company reserves the right to modify its product range at any time. Each Product is described on the Website with the greatest possible accuracy. However, the Company cannot be held liable for any errors or omissions.

The Customer acknowledges that images, photographs, and colors of the Products may not perfectly reflect actual colors due to internet browsers. Photos are as accurate as possible but are not contractually binding.

Article 3 – Pre-contractual Information
The Customer acknowledges having received, prior to placing an order and concluding a contract, these GTC and all information listed in Article L.221-5 of the French Consumer Code in a clear and understandable manner.

Article 4 – Prices
Prices are indicated in euros, all taxes included (VAT and applicable taxes at the time of the order), excluding processing and shipping fees unless otherwise stated.

All orders, regardless of origin, are payable in euros (€).

For orders shipped outside mainland France, any customs duties, local taxes, import duties, or state taxes are the responsibility of the Customer.

The Company reserves the right to modify prices at any time; however, Products will be invoiced based on the rates in effect at the time the order is validated, subject to availability.

Products remain the property of the Company until full payment is received. Risk of loss or damage transfers to the Customer upon physical receipt of the Products.

Article 5 – Orders
Any order confirmation on www.ycooparis.com implies full acceptance of these GTC without exception.

Order confirmation constitutes signature and acceptance of the transactions carried out. Orders are final and cannot be canceled.

The Company reserves the right not to record a payment or confirm an order for any reason, particularly in case of supply issues or problems with the order.

The Company also reserves the right to refuse an order or restrict access to its online store in cases of suspected fraud, abusive behavior, or non-compliance with these GTC.

Article 6 – Payment
Validation of an order implies the obligation to pay the indicated price.

Payment is made in a single installment by credit card (Visa, Mastercard, American Express) or PayPal. Payment authorization is irrevocable, and the card is charged upon order validation.

The Customer guarantees that they have the necessary authorization to use the chosen payment method.

In case of payment failure, incorrect address, or other issues, the Company reserves the right to suspend or cancel the order.

The sale is considered final upon confirmation of the order and full payment collection.

Article 7 – Right of Withdrawal
In accordance with Article L.121-21 of the French Consumer Code, the Customer has 14 days from receipt of the order to exercise their right of withdrawal and return the Product without penalty.

This right may be exercised by emailing hello@ycooparis.com or via the return request form on the Website.

Products must be returned in original packaging, with tags, in new, unworn, unwashed condition, within 14 days of notifying the Company. Non-compliant returns may be refused.

Returns from mainland France include a prepaid label, with a €4 fee deducted from the refund.

For returns outside mainland France, Products must be sent at the Customer’s expense to:
YCOO PARIS, 70 avenue Victor Hugo, Fashion Center, 93300 Aubervilliers, France, marked “Website Return – Order Number”.

Customs fees are not covered and may be deducted from refunds if applicable.

Refunds (excluding initial shipping costs) are processed within 15 business days after receipt of the return, using the original payment method.

The Company reserves the right to refuse refunds in case of non-compliance or abusive return behavior.

Article 8 – Availability
Products are available while displayed on the Website and within stock limits. If unavailable after ordering, the Customer will be notified and refunded.

Article 9 – Delivery
Orders are delivered to the address provided by the Customer.

Delivery times are indicative. The Company is not liable for delays caused by carriers.

If delivery exceeds 30 days, the sale may be canceled and refunded.

Incorrect addresses may result in reshipping at the Customer’s expense.

Upon delivery, the Customer must check the condition of the Products. Any issue must be reported within 15 days to hello@ycooparis.com.

Article 10 – Warranties
The Company’s liability is limited to the purchase price of the Product.

Products benefit from legal guarantees of conformity (Articles L.217-3 et seq.) and hidden defects (Articles 1641 et seq. of the Civil Code).

Customers have 2 years to act under these guarantees. Claims must be submitted via email, and Products returned in original condition.

The Company is not liable for misuse, internet-related damages, or legal non-compliance in the destination country.

Force majeure events (as defined by Article 1218 of the Civil Code) suspend contractual obligations.

Article 11 – Intellectual Property
All elements of the Website remain the exclusive intellectual property of the Company. Any reproduction or use without prior written consent is prohibited.

Article 12 – Personal Data
The Company collects personal data necessary for order processing and service improvement.

Data may be shared with service providers and retained for legal and security purposes.

In accordance with French law (Law No. 78-17 of January 6, 1978), Customers have rights of access, modification, and deletion, exercisable via hello@ycooparis.com.

Article 13 – Governing Law and Disputes
These GTC are governed by French law. In case of translation, the French version prevails.

Any dispute shall fall under the exclusive jurisdiction of French courts. The competent court is that of the defendant’s place of residence.
